New Jersey Estate Executor Requirements

07.13.2019

State of New Jersey statutes do not lay out particular requirements in order to be named an estate executor in the State of New Jersey. Essentially, it just has to be an adult. The court will then officially appoint that person unless there is clear evidence that this person gained the position through fraud or misconduct or is otherwise unfit to serve. Incapacitated people also cannot be appointed as estate executors.

Non-resident estate executors in New Jersey are required to post an executor surety bond unless the will specifically waives the requirement.

The court may require an executor surety bond from all executors in order to protect the interests of the estate and its beneficiaries.
